Purolator True North Small Business Grant Contest - 2023 Official Contest Rules (the “Rules”)


NO PURCHASE NECESSARY TO ENTER OR WIN. THE CONTEST IS OPEN TO ALL LEGAL RESIDENTS AND ELIGIBLE SMALL BUSINESSES DOMICILED IN CANADA THAT FALL WITHIN THE ELIGIBILITY REQUIREMENTS AS SPECIFIED IN THE TERMS BELOW. VOID ELSEWHERE AND WHERE PROHIBITED BY LAW. DO NOT PARTICIPATE IN THE CONTEST IF YOU DO NOT FALL WITHIN THE ELIGIBILITY REQUIREMENTS BELOW.
    Contest Period
  1. Purolator True North Small Business Contest (the “Contest”) commences at 10:00:00 AM ET on April 26, 2023 and ends at such time the Grant and Finalist Winners ( as defined in section 19 below) are publicly announced, or at 11:59:59 PM ET on December 31, 2023, whichever is earlier (the “Contest Period”).

    The Contest consists of four (4) important time periods:
    1. Nomination submission period (the “Nomination Submission Period”): 10:00:00 AM ET on April 26, 2023 to 11:59:59 PM ET on June 14, 2023.

      All entries must be received by 11:59:59 PM ET June 14, 2023 (the “Entry Closing Time”). Entries submitted after the Entry Closing Time shall be void. Purolator Inc.’s servers will be the official time-keeping device for the Contest.
    2. Entry evaluation and judging, and Grant Prize finalists and winner notification: June 15, 2023 up to October 13, 2023
    3. Public announcement of Grant Prize winners and Community’s Choice Award Voting: October 16 – October 31, 2023
    4. Public announcement of the winner of the Community’s Choice Award Voting: around November 29, 2023 and up to December 31, 2023
    The Contest is sponsored and administered solely by Purolator Inc. (“Sponsor” or “Purolator”) and is no way sponsored, endorsed or administered by, or associated with Visa®* as named in the prize list in sections 6 through 9 herein. Purolator shall be solely responsible for the delivery of the Prizes (as defined in Section 11) the selected qualified winners.
  2. Eligible Persons
  3. Nominator Eligibility

    To be eligible to participate in the Contest as a nominator (the “Nominator”), individuals must be: (a) legal residents of Canada, who have reached the age of majority in their Province or Territory of residence at the time of entry, and enter the Contest as outlined in Section 15; and (b) owners, founders, employees, customers, partners, vendors, or other general supporters which includes Purolator Frontline Employees, of the eligible nominated small business (the “SMB”) as set out in Section 3. For the purposes of this Contest, a “Purolator Frontline Employee” is defined as a courier, retail, or terminal/hub employee of Purolator Inc. (the “Sponsor” or “Purolator”). A Nominator cannot be: (c) (i) Head office or corporate employees, directors, or executives of the Sponsor; (ii) any employee of the Sponsor’s advertising, promotion and fulfillment agencies involved in the development or execution of the Contest (the “Contest Administrator”) in any way; (iii) any persons or entities involved in administering or judging the Contest; and (iv) all persons with whom those specified in (c)(i)(ii) and (iii)above are domiciled or immediately related.

    For the purposes of these Rules, two people are “immediately related” if one is the husband, wife, spouse, common-law partner, son, stepson, son-in-law, daughter, stepdaughter, daughter-in-law, sister, stepsister, sister-in-law, brother, stepbrother, brother-in-law, mother, stepmother, mother-in-law, father, stepfather or father-in-law of the other.
  4. Grant Nominee Eligibility

    To be eligible to participate in the Contest as a grant nominee (the “Grant Nominee”), a small business must: (a) be based in Canada and legally licensed or registered to operate in Canada, and/or in a Province or Territory, as applicable; (b) have 50 employees or less; and (c) be in good financial standing (no petition in bankruptcy or insolvency) throughout the Contest Period including winner announcement, and be nominated into the Contest as set out in Section 15.

    The Grant Nominee cannot have employees that are: (d) (i) employees, directors, officers, representatives and agents of the Sponsor; (ii) any employee of the Sponsor’s advertising, promotion and fulfillment agencies involved in the development or execution of the Contest in any way; and (iii) any persons or entities involved in administering or judging the Contest. Also, the Grant Nominee cannot have owners, founders, or main investors of a small business that are: (e) (i) employees, directors, officers, representatives and agents of the Sponsor; (ii) any employee of the Sponsor’s advertising, promotion and fulfillment agencies involved in the development or execution of the Contest in any way; and (iii) any persons or entities involved in administering or judging the Contest; and iv) all persons with whom those specified in (f)(i)(ii) and (iii) above are domiciled or immediately related.

    One (1) of the four (4) Grant Prizes will be reserved exclusively for a Purolator Customer. For the purposes of these Rules, a “Purolator Customer” is defined as having a Purolator Business Account in good standing at the time of Contest Entry and the end of the Contest Period, and has made at least one shipment between June 14, 2022 to June 14, 2023. Purolator may award more than one (1) Grant Prize to a Purolator Customer if selected as a top scoring candidate as set out in Section 19
  5. A Nominator or Grant Nominee must meet the eligibility requirements set out in these Rules from the time of entry until winner confirmation (if he/she/they becomes a winner). Entrants are responsible for determining whether any policy prohibits them entering the Contest or receiving a Prize, or if any permissions are required from senior management of their business to enter or receive.
  6. Voter Eligibility
  7. To be eligible to participate in the Contest as a voter (the “Voter”), individuals must be: (a) legal residents of Canada, who have reached the age of majority in their Province or Territory of residence at the time of entry, and enter their vote as outlined in Section 23; and (b) owners, founders, employees, customers, partners, vendors, or other general supporters. A Voter cannot be: (c) (i) an employee of the Sponsor; (ii) any employee of the Contest Administrator; (iii) any persons or entities involved in administering or judging the Contest; and (iv) all persons with whom those specified in (c)(i)(ii) and (iii)above are domiciled or immediately related.
  8. Prizes and Odds of Winning
  9. There will be four (4) individual nomination prizes (a “Nomination Prize”) available to be won by eligible Nominators, each consisting of one (1) $500 (inclusive of HST) Visa* gift card. One (1) of the four (4) Nomination Prizes will be reserved exclusively for a Purolator Frontline Employee, and will be awarded as a taxable benefit to the selected employee.

    There will be six (6) individual finalist prizes available to be won by eligible Grant Nominees, each consisting of one (1) $500 (inclusive of HST) Visa* gift card, and may include other benefits as determined by the Sponsor (a “Finalist Prize”).
  10. There will be four (4) individual grant prizes (a “Grant Prize”) available to be won by eligible Grant Nominees through the Contest. One (1) of the four (4) Grant Prizes will be reserved for a Purolator Customer.
  11. Each Grant Prize consists of:
    1. $25,000.00 in cash, awarded to the SMB by cheque, money order or money transfer;
    2. $500 in Purolator shipping credits, and may include other benefits as determined by the Sponsor. The $500 in Purolator shipping credits will allow the winning Entrant to use a variety of Purolator services to ship packages up to the value of $500. The $500 in shipping credits cannot be converted into, or provided, in cash and expires two (2) years after issue.
  12. All prizes are in CAD dollars and inclusive of HST.
  13. There will be three (3) individual voting prizes (a “Voting Prize”) available to be won by eligible Voters, each consisting of one (1) $250 (inclusive of HST) Visa* gift card.
  14. The approximate odds of winning a Prize depend on the total number of eligible Entries received by the Contest Closing Time.
  15. The total prizes consist of four (4) Grant Prizes, six (6) Finalist Prizes, four (4) Nomination Prizes, one (1) People’s Choice Award, and three (3) Voter Prizes (as selected based on Sections 18, 19, and 23 below) valued at a total of CAD $113,250.00 (collectively, the “Prizes”). The Grant Prize Winners, Finalist Prize Winners, Nomination Prize Winners, and Voting Prize Winners (collectively, the “Winners”) must meet the corresponding eligibility requirements outlined in Sections 2-5 above.

    The Visa* gift cards available as Prizes, may not be exchanged for cash, are non-transferable, non-refundable, non-salable, and must be accepted as awarded. The Visa* gift card awards are subject to the issuer’s gift card terms, conditions and restrictions. Recipients of Visa* gift cards, under this Contest, are solely responsible for all incidental costs and expenses associated with the gift card, including any service fees, not specifically referred to herein. Purolator reserves the right, in its sole discretion, to not cover any costs or expenses incurred by a winner under this Contest. If a Contest winner does not utilize any part(s) of the award, then any such part(s) not utilized will be forfeited in their entirety and nothing will be substituted in its place.
  16. All amounts and costs related to any Prizes, including but not limited to all income, sales, and other taxes (and the reporting thereof) imposed as a result of the award of a Prize, which are not expressly covered by the Sponsor are the responsibility of the individual winners. It is the individual winners’ responsibility to understand and abide by any federal, provincial, territorial, local or foreign tax laws that may apply to receipt of a Prize. The charitable donation made in connection with the pay it forward voting component of this contest will be a taxable benefit to Purolator whose name will appear on the official donation receipt.
  17. Cash Prizes may not be assigned or transferred to another person. If the Prize cannot be awarded due to circumstances beyond the control of Sponsor, a substitute prize of equal or greater retail value may be awarded.
  18. Non-cash Prizes may not be redeemed for cash, sold, traded, used for commercial purposes or transferred. A person eligible to win a Prize must accept the Prize as awarded and may not transfer such Prize or substitute or exchange for, or apply the Prize’s value towards, cash or a higher cost or alternative prize. All Prizes are non-refundable, cannot be replaced if lost or stolen and are provided on an “as is” basis, without any representation or warranty of any kind. The Sponsor reserves the right, in its sole and absolute discretion, to make substitutions of equivalent or greater kind or value in the event of the unavailability of all or part of a Prize or for any other reason whatsoever.
  19. Entry Requirements. (No Purchase Necessary.)
  20. This Contest involves Nominators submitting their information on a contest web page (“Contest Website”) together with their written contest submission, which shall consist of the Nominators’ description of the Grant Nominee’s business in relation to the short essays of “how the small business contributes to the community and why the small business should receive a grant” set out on the Contest Website (the “Submission(s)”) together comprising an entry (“Entry” or “Entries”). The Contest can be entered in two ways. The first shall be by email invitation from Purolator to existing Purolator Customers.

    Purolator Customers with valid email addresses on file will receive an email from Purolator inviting them to enter into the Contest, and this email will link to the Contest Website, in English:

    There may also be banners on Purolator’s website which will advertise the Contest and which will have a link to the landing page to the Contest Website. Purolator Customers can also participate through Purolator advertising for the Contest on signage, digital communications, Facebook, Instagram, and other social media.

    The second way to enter the Contest shall be from individuals from the general public and Purolator Frontline Employees in support of a SMB (“SMB Community Member(s)”). SMB Community Members will be invited through paid advertisements by Purolator on signage, bulletins, digital communications, and social media such as Facebook, Instagram, and other media and social media to enter this contest by providing their written contest Submission to the Contest Website link provided on the advertisements. SMB Community Members may also be invited by other SMB Community Members to participate in the Contest, should they choose to share the Contest through their permissioned personal contacts through their own channels of communication.

    To be eligible for one (1) of the four (4) Nomination Prizes, Purolator Customers or SMB Community members must have submitted a complete and unique (as determined by the Sponsor or administrators) nomination Entry through one of the methods listed above.

    To be eligible for one (1) of the four (4) Grant Prizes, or one (1) of the six (6) Finalist Prizes as a Grant Nominee, a SMB must have a complete and unique (as determined by the Sponsor or administrators) nomination entry submitted by a Purolator Customer or SMB Community Member through one of methods listed above. If a Grant Nominee wants to also be eligible to receive the $500 Purolator shipping credits for one (1) of the Grant Prizes, and they are not a Purolator Customer, they will need to sign up for a Purolator account within ten (10) days of being notified as the selected Grant Prize Winner, as set out in Section 20 below.

    To be eligible for one (1) of the three (3) Voting Prizes, Purolator Customers or SMB Community members must have submitted a complete and unique (as determined by the Sponsor or administrators) vote, as set out in Section 23 below.

    Each individual who enters the Contest (the “Entrant”) agrees that their Entry is subject to the provisions of Section 22 below. Submissions will become the property of Purolator. The Winners will be required to complete the Declaration and Release described in Sections 24-27 below.
  21. Limit of five (5) Entries per person during the Contest Period. Each written Submission must be complete, unique, and be for a unique SMB. If any Entrant attempts to obtain more than the specified number of Entries, or duplicates Entries, or encourages others to duplicate Entries, the Sponsor may, in its sole and absolute discretion, disqualify the Entrant from the Contest and disqualify all of that Entrant’s entries.
  22. All Entries are subject to verification at any time. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility from any Nominator or Grant Nominee, which proof shall be in the form required by the Sponsor. Failure to provide proof of identity and/or eligibility to the satisfaction of the Sponsor within three (3) business days may result in disqualification.
  23. How Prizes are Awarded for the Nomination, Finalist, and Grant Prizes
  24. Nomination Prizes

    There will be a total of four (4) random draws, one (1) for each Nomination Prize, allocated as follows:
    1. Three (3) random draws (from among all eligible Entries, excluding Purolator Frontline Employees, received during the Contest Period; and
    2. One (1) random draw from among all eligible Entries from Purolator Frontline Employees, received during the Contest Period.

      The above noted draws will be made to select the potential Nomination Prize winners and will be held on or about 1:30:00 p.m. ET on June 29, 2023 at the office of Purolator Inc., 2727 Meadowpine Blvd., Mississauga, Ontario, L5N 8C7 (the “Nomination Prize Draw”), in accordance with the Rules.
    Purolator and the Contest Administrator reserve the right to reschedule the Nomination Prize Draw(s) at any time and for any reason without prior notice

    Nomination Prize Winner Notification: The Nomination Prize Winners will be contacted by the Sponsor or the Contest Administrator by telephone or email by July 31, 2023. In the event that the Sponsor or the Contest Administrator is unable to contact the selected Entrants by telephone or email after three (3) attempts within five (5) business days of the initial contact date, the Sponsor reserves the right to disqualify the selected Entrants and such Entrant will be deemed to have forfeited their entitlement to receive the Nomination Prize, at which time alternate Entrants will be awarded the Nomination Prizes. Neither the Sponsor nor the Contest Administrator will be responsible for any failed attempts to contact selected Entrants.

    Through the Nomination Prize winner notification process, the potential Nomination Prize Winners must confirm their eligibility and indicate their willingness to accept the applicable Nomination Prize. The potential Nomination Prize Winner will then receive official notification via email. No communications will be entered into other than with the potential Nomination Prize Winners. Due to the random nature of the Nomination Prize Draw, selected winners must complete a Declaration and Release pursuant to Section 24-27 herein, which includes correctly answering a multi-step mathematical skill-testing question without human, electronic, mechanical or other assistance
  25. Grant and Finalist Prizes

    A judging panel will award the Grant Prize to four (4) Grant Prize winners and the Finalist Prize to six (6) Finalist winners based on the winning Submissions and supplementary materials as determined in accordance with the Criteria and the process described below and in accordance with these Rules, including the verification requirements (the “Grant and Finalist Winner Selection”). The Grant and Finalist Winner Selection will start from June 15, 2023 in Toronto, Ontario from all eligible Contest entries received during the Contest Period. The Sponsor shall officially and publicly announce the Grant and Finalist Prize Winners by email, any time starting after October 16, 2023. The Competition will be judged in 3 phases:

    Phase 1: All nomination Submissions will be entered into a pre-screening process whereby all Submissions will be evaluated by a third party agency team and the Sponsor. The pre-screening process will evaluate Submissions based on Phase 1 Criteria. A minimum of 10 entries will advance to Phase 2 of the adjudication process. In the event of ties, the pre-screening panel will re-evaluate the tied Submissions to further narrow down the list to achieve the top Submissions.

    Phase 1 Criteria: Submissions will be evaluated on the following criteria:
    Quality of Content: 35%
    Impact, Business Model & Values: 60%
    Community Support: 5%

    Entrants will be eliminated if the Submission is not complete, does not follow the requested theme, or does not have a positive brand tone, as determined by the Sponsor.

    Phase 2: The Contest Administrator will contact the nominated SMBs of a minimum of 10 of the top scoring Submissions from Phase 1 to confirm their interest, participation, and advancement in the Contest. In the event that the Sponsor or the Contest Administrator is unable to contact the selected SMB after three (3) attempts within five (5) business days of the initial contact date, the Sponsor reserves the right to disqualify the selected SMB and will be deemed to have forfeited their candidacy for the Grant Prize.

    Upon confirmation of participation, Phase 2 candidates (the “Candidate(s)”) will be required to submit supplementary material (“Supplementary Material”), as requested by the Contest Administrator and/or the Sponsor, in order to qualify for advancement in Phase 3 which may include:
    • More information about their small business including but not limited to the number of employees, current financial status information, and a declaration of eligibility
    • Pre-recorded video presentation, interview, or live interview on topics related but not limited to, “What would you like the judges to know about your business?”, “How would the grant funds be used to grow your business?”, and “What challenges has your small business faced?”.
    In the event that the Candidate is unable to provide Supplementary Materials in the timeframe allotted, the Sponsor reserves the right to disqualify the selected Candidate and will be deemed to have forfeited their candidacy for a Grant or Finalist Prize.

    Phase 2 Criteria: Submissions and Supplementary Materials for each Candidate will be evaluated by a Third party agency team and the Sponsor based on the following criteria:
    Quality of Content: 35%
    Impact, Business Model & Values: 60%
    Community Support: 5%

    Candidates will be eliminated if the Submission and Supplementary Materials are not complete, does not follow the requested theme, or does not have a positive brand tone, as determined by the Sponsor.

    Phase 3: The Contest Administrator will consolidate evaluations and compile a list of up to 8 top scoring Candidates (based on scores from Phase 2) which will be presented to the final judging panel comprised of individuals from the community and the Sponsor.

    Submissions and supplementary materials for each Candidate will be evaluated based on the following criteria: Quality of Content: 35% Impact, Business Model & Values: 60% Community Support: 5%

    During the Phase 3 judging period from September 5 to 15, 2023, all scores for each Candidate will be added together and the four (4) Candidates with the highest scores will be declared a Grant Prize winner (“Grant Prize Winner”). In the event of ties, the judges will each cast 1 vote, and the Submission with the most votes will be declared a Grant Prize Winner. The remaining top Candidates from Phase 2 will be ranked in order of scoring, be declared as a Finalist Prize Winner (“Finalist Prize Winner”), and used as alternate winners for the Grant Prize in declining order, if necessary.
  26. Grant Prize Winner Notification: The Grant Prize Winners will be contacted by the Sponsor or the Contest Administrator by telephone or email by October 6, 2023. In the event that the Sponsor or the Contest Administrator is unable to contact the selected Candidates by telephone or email after three (3) attempts within five (5) business days of the initial contact date, the Sponsor reserves the right to disqualify the selected Candidates and such Candidates will be deemed to have forfeited his/her entitlement to receive the Prize, at which time alternate Candidates will be awarded a Grant Prize. Neither the Sponsor nor the Contest Administrator will be responsible for any failed attempts to contact selected Candidates.

    If the chosen Grant Winners are not Purolator customers, then a Purolator representative shall have until October 31, 2023 to contact them to ask them whether or not they will become a Purolator account holder; if a Grant Prize Winner would like to be eligible to receive the second portion of the Grant Prize, the $500 in Purolator shipping credits, they shall have ten (10) days of being notified as the selected Winners, to apply to become a Purolator account holder, and shall provide Purolator their account number or the second part of the prize will not be awarded to the Grant Prize Winners.

    If the first alternate Candidate is disqualified as the Grant Prize Winner, another alternate potential Grant Prize Winner will be selected from among the remaining eligible Candidates, through a process similar to the one that selected the original potential Grant Prize Winner, subject to these Rules. Through the Grant Prize Winner notification process, the potential Winner must confirm his/her/their/its small business’s eligibility and indicate his/her/their/its willingness to accept the applicable Grant Prize on behalf of their small business. The potential Grant Prize Winner will then receive official notification via email. No communications will be entered into other than with the potential Grant Prize Winners.
  27. Finalist Prize Winner Notification: The Finalist Prize Winners will be contacted by the Sponsor or the Contest Administrator by telephone or email by October 11, 2023. In the event that the Sponsor or the Contest Administrator is unable to contact the selected Candidates by telephone or email after three (3) attempts within five (5) business days of the initial contact date, the Sponsor reserves the right to disqualify the selected Candidates and such Candidates will be deemed to have forfeited his/her entitlement to receive the Prize, at which time alternate Candidates may be awarded a Finalist Prize. Neither the Sponsor nor the Contest Administrator will be responsible for any failed attempts to contact selected Candidates
  28. Submission Requirements
  29. By participating in the Contest, each Entrant and Candidate agrees to be bound by these Rules and by the interpretation of these Rules by the Sponsor, and further warrants and represents that his/her/their/its Submission or Supplementary Material:

    i. is original to the Entrant and Candidate and that the Entrant and Candidate have all necessary rights in and to the Submission (and all components thereof – e.g. music, images, etc.) to participate in the Contest;
    ii. does not violate any law, statute, ordinance or regulation;
    iii. does not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence;
    iv. will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims for payment whatsoever; and
    v. is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following:
    • Nudity;
    • Consumption or promotion of illegal drugs;
    • Explicit or graphic sexual activity, or sexual innuendo;
    • Crude, vulgar or offensive language and/or symbols;
    • Derogatory characterizations of any ethnic, racial, sexual or religious groups;
    • Content that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct;
    • Personal information of individuals; including, without limitation, telephone numbers and addresses (physical or electronic);
    • Negative comparisons or solicitations for products or services of Nominees and Sponsors
    • Any identifiable third party products, trade-marks, brands and/or logos, other than those of Sponsor; And only those of Nominee with permission or consent of Nominee. For example, any clothing worn and/or products appearing in your video must not contain any visible logos, trade-marks or other third party materials (note: all identifiable third party products, trade-marks, brands and/or logos must be blurred out so as to be unrecognizable) unless there is consent of the owner of the intellectual property;
    • Conduct or other activities in violation of these Terms; and/or
    • Any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole discretion. 
    The Sponsor or Third party agency (the “Reviewer(s)”) may initially screen each Submission. Any Submission that the Reviewer deems, in its sole discretion, to violate the terms and conditions set forth in these Rules will not be posted or submitted for entry into the Winner Selection.

    By entering the Contest and submitting an Entry or Supplementary Material, each Entrant or Candidate: (i) grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use his/her/their/its Submission, in whole or in part, for advertising or promoting the Contest or for any other reason; (ii) waives all moral rights in and to his/her/their/its Submission in favour of the Sponsor; and (iii) agrees to release and hold harmless the Sponsor, the Contest Administrator and each of their respective agents, employees, directors, successors, and assigns (collectively, the “Releasees”) from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action (iv) agrees to receive email communications about the Contest from the Sponsor or Contest Administrator.
  30. Community’s Choice Award Voting

    1. During the Community’s Choice Award voting period, the small businesses that have been selected as Grant Prize Winners will have the opportunity to win the Community’s Choice Award which consists of one (1) $500 gift card and one (1) $5,000 donation from Purolator to pay it forward to the Registered Canadian food bank of their choice. The qualifying small business with the highest number of votes on the voting forms submitted by eligible voters, as stated in Section 4, on https://cloud.connect.purolator.com/small-business-grants and https://cloud.connect.purolator.com/small-business-grants?lang=fr at the end of the voting period at 11:59 PM ET on October 31, 2023 will be declared the winner of the Community’s Choice Award.
    2. For every eligible vote, Purolator will donate $1 CAN to Purolator Tackle Hunger (https://www.purolator.com/en/purolator-tackle-hunger), to a maximum of $10,000 CAN.
    3. Limit of one (1) vote per person during the Community’s Choice Voting Period. Duplicate votes received from any one (1) person, or through fraudulent practices, will be void and will not be counted toward the final vote tally. Grant Prize Winners are prohibited from obtaining votes by any fraudulent or inappropriate means which include, but are not limited to, the following: (a) Buying or knowingly receiving purchased votes in any manner from anyone, (b) Offering prizes or other inducements for votes to members of the public, (c) The use of any automated, robotic, repetitive, programmed, or similar registration or voting methods. (d) Any questionable activity that increases votes for an entry, including without limitation any attempts to artificially increase vote totals or trade votes. However, Grant Prize Winners are allowed to run ads/sponsored posts or promotions related to the Contest that do not require the winner of the Entrant’s promotion to have voted for their Entry. Sponsor reserves the right, in its sole discretion, to disqualify any Grant Prize Winner who is suspected of violating these terms or otherwise tampering with the Entry, voting or selection process.
    4. The small business winner of the Community’s Choice Award will be notified via email or phone by November 15, 2023. The $500 Visa* gift card and donation to Registered Canadian food bank will be delivered by December 31, 2023.
    5. There will be a total of three (3) random draws, one (1) for each $250 Visa* gift card Voting Prize.
    The draws will be made to select the potential Voting Prize Winners and will be held on or about 1:30:00 p.m. ET on November 8, 2023 at the office of Purolator Inc., 2727 Meadowpine Blvd., Mississauga, Ontario, L5N 8C7 (the “Community’s Choice Award Vote Draw”), in accordance with the Rules.

    The Voting Prize Winners will be contacted by the Sponsor or the Contest Administrator by telephone or email by November 15, 2023. In the event that the Sponsor or the Contest Administrator is unable to contact the selected Entrants by telephone or email after three (3) attempts within five (5) business days of the initial contact date, the Sponsor reserves the right to disqualify the selected Entrants and such Entrant will be deemed to have forfeited their entitlement to receive the Voting Prize, at which time alternate Entrants will be awarded the Voting Prizes. Neither the Sponsor nor the Contest Administrator will be responsible for any failed attempts to contact selected Entrants.

    Through the Voting Prize winner notification process, the potential Voting Prize Winners must confirm their eligibility and indicate their willingness to accept the applicable Voting Prize. The potential Voting Prize Winner will then receive official notification via email. No communications will be entered into other than with the potential Voting Prize Winners. Due to the random nature of the Voting Prize Draw, selected winners must complete a Declaration and Release pursuant to Section 24 herein, which includes correctly answering a multi-step mathematical skill-testing question without human, electronic, mechanical or other assistance.

    The Voting Prizes will be delivered to the winners by December 31, 2023.
  31. Declaration and Release
  32. Before being confirmed as a Winner of one (1) of the four (4) Grant Prizes, one (1) of the six (6) Finalist Prizes, or one (1) of the four (4) Nomination Prizes, the potential Grant Prize, Finalist Prize, and Nomination Prize Winners must each complete and return, within five (5) business days of the initial contact date, a Declaration and Release Form (the “Declaration and Release”), which (among other things):

    A. confirms compliance with these Rules;

    B. acknowledges acceptance of the Prize as awarded;

    C. in relation to the Nomination Prizes, contains a time-limited, multi-step mathematical skill-testing question which must be correctly answered by the selected Nomination Prize winners;

    D. releases the Sponsor and their affiliates and each of its and their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, the potential Winner’s participation therein and the awarding and use/misuse of the Prize or any portion thereof or participation in any Prize-related activity;

    E. confirms the potential Winner’s consent to the publication, reproduction and/or other use of his/her/their/its/its name, company name, company website, company address, voice, statements about the Contest and/or photograph and/or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including, without limitation, print, broadcast, mobile and the internet (“Promotion(s)”);

    F. authorizes the Sponsor to modify the Submission for the purposes of the Promotions; and

    G. assigns all copyright in the Submission to the Sponsor and its affiliates, and waives any moral rights the Entrant may have in the Submission or Candidate may have with Supplementary Materials.
  33. If a potential Grant Prize, Finalist Prize, Nomination Prize, or Voter Prize Winner fails to return the properly executed Declaration and Release within the specified time period, the Sponsor may, in its sole and absolute discretion, disqualify them, thereby forfeiting any and all rights to a Prize. In the event of such a disqualification, an alternate potentialGrant Prize, Finalist Prize, or Nomination Prize Winner, will be selected from among the remaining eligible entries, through a process similar to the one that selected the original potential Grant Prize, Finalist Prize, or Nomination Prize Winner, subject to these Rules.
  34. If a selected potential Grant Prize, Finalist Prize,, or Nomination Prize Winner; do not meet the eligibility requirements, do not complete and return the Declaration and Release, are unable or unwilling to accept the Prize as offered or elects to decline the Prize, they will be disqualified and an alternate potential Grant Prize, Finalist Prize,or Nomination Prize Winner; will be selected from among the remaining eligible entries, through a process similar to the one that selected the original potential Grant Prize, Finalist Prize, or Nomination Prize Winner; subject to these Rules. Any disqualified Winner will not receive any alternate prize, substitution or compensation.
  35. Upon satisfaction of all requirements of these Rules, including, without limitation, receipt of the completed Declaration and Release, the final Grant Prize, Finalist Prize, Nomination Prize, and Voter Prize Winners will be contacted to make Prize delivery arrangements. The $25,000 cash and $500 shipping credit prizes will be delivered to the Grant Prize Winners at the latest by December 31, 2023.
  36. Privacy
  37. The Sponsor respects your right to privacy and works at all times to comply with all applicable data protection and privacy laws. Except as expressly set out in these Rules, in the Sponsor’s Privacy Policy (available at https://www.purolator.com/en/legal/privacy.page? ), or as otherwise agreed to by you, any personal information provided in connection with this Contest will only be collected, used and disclosed by the Sponsor and its third party partners and service providers, including, without limitation, the Contest Administrator, for the purposes of administering and conducting this Contest, including, without limitation, verification of eligibility and identity and awarding and delivering Prizes. Such information will be subject to the general laws applicable within those jurisdictions, including, without limitation, possible access by regulatory authorities. The Sponsor will not sell, share or otherwise disclose personal information provided in connection with this Contest to or with third parties or agents, other than to third parties or agents engaged by the Sponsor to fulfill the above purposes or as permitted or required by the applicable laws.
  38. Additional Terms and Restrictions
  39. By participating in this Contest, Entrants and Candidates agree to abide by and be bound by these Rules and the decisions of the Sponsor and the Contest Administrator, which shall be final and binding on all Entrants and Candidates in all matters relating to this Contest. In the event an Entrant or Candidate wins a Prize and is later found to be in violation of these Rules, he/she/they will be required to forfeit the Prize or to reimburse Sponsor for the stated value of the Prize if such violation is discovered after winner has used the Prize. False, fraudulent or deceptive entries or acts shall render Entrants and Candidates ineligible for the Prize.
  40. Proof of sending (regardless of method) is not proof of receipt by the Sponsor or Contest Administrator. Incomplete, altered, mutilated or garbled entries will be disqualified. The Releasees are not responsible for lost, late, misdirected, garbled, stolen, incomplete, invalid, unintelligible or damaged entries, or for entries submitted in a manner that is not expressly allowed under these Rules, or for any entry not submitted or received due to any technical error or failure, unauthorized human intervention, inaccurate capture or mis-entry of any required information, the effects of hackers, the failure of any electronic equipment, computer transmissions and/or network connections or any other reason beyond Sponsor’s reasonable control; all of which will be disqualified. The Releasees are not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including, without limitation: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online Entrant's or Candidate’s ability to participate in the Contest, and any injury or damage to Entrant’s, Candidates, or any other person’s computer related to or resulting from participating in or downloading any information necessary to participate in the Contest. Entrants and Candidates are restricted to use of ordinary and typical computer equipment and internet access use in respect of the Contest.
  41. The Releasees are not responsible for the cancellation or postponement of any component of this Contest or any associated programs and materials. The Releasees are not responsible for any other errors of any kind, whether computer, technical, typographical, printing, display, human or otherwise, relating to or in connection with the Contest. The Releasees are not responsible for typographical or other errors in the offer or administration of this Contest, including, without limitation, errors which may occur in connection with the printing, display or advertising of this Contest, these Rules, administration or execution of the Contest, the conducting of the prize selection, the cancellation of any element of a Prize, the processing of entries or in the selection or announcement of a Prize or Prize winner.
  42. Each Entrant must submit a Nomination entry and participate in the Contest on his/her/their/its own behalf. Any entry submitted on behalf of another individual, on behalf of a group or organization, or using another person’s email address, name or other personal information will be disqualified and ineligible to claim a Nomination Prize.

    Each Candidate must submit Supplementary Material and participate in the Contest on his/her/their/its small business’s behalf. Any entry submitted on behalf of another individual, on behalf of a group or organization, or using another person’s or organization’s email address, name or other personal information will be disqualified and ineligible to claim a Grant Prize.
  43. Any attempt by any Entrant to obtain more than the specified number of entries by using (or attempting to use) multiple names, identities, email addresses, registrations or logins, or by any other means whatsoever, will entitle the Sponsor, in its sole and absolute discretion, to void that Entrant’s entries and disqualify that Entrant from the Contest. Entries by any means which subvert the entry process will be void. Any entry that is determined by the Sponsor, in its sole and absolute discretion, to have failed to have been fully completed and submitted during the Contest Period will be rejected. Use (or attempted use) of any automated, macro, script, robotic or other systems or programs to enter or otherwise participate in, subvert or disrupt the Contest, and any other attempt to manipulate, tamper with or defraud any element of this Contest, is prohibited and is grounds for disqualification by the Sponsor in its sole and absolute discretion.
  44. In the event of a dispute as to any entry, the authorized account holder of the email address included in the Entry for that entry will be deemed to be the Entrant and he/she/they/it must be eligible according to these Rules. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. All entries received become the property of the Sponsor and will not be returned or acknowledged.
  45. The sole determinant of the time of receipt of an entry for the purposes of determining the eligibility of that entry shall be Purolator’s or the Contest Administrator's computer or server.
  46. By participating in the Contest, except to the extent prohibited by applicable legislation, each Entrant and Candidate:
    A. consents to the publication, reproduction and/or other use of his/her/their/its name, company name, company website, company address, voice, statements about the Contest and/or photograph and/or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including, without limitation, print, broadcast and the internet and any winning Entrants or Candidates, Grant Prize, Finalist Prize, and Nomination Prize; agree to work with Purolator on the creation of videos and other content creation regarding their stories and their personal biographies, and all content developed becomes the property of the Sponsor;

    B. releases and agrees to defend and indemnify the Releasees from and against any and all liability, claims, losses, actions or damages of any kind, whether actual, incidental or consequential, for injury (including but not limited to death), damages, losses or expenses arising out of or relating to an Entrant’s or Candidate’s participation in this Contest, or the acceptance, possession or use/misuse of any Prize or participation in prize-related activities (including but not limited to activity related thereto);

    C. agrees not to make any claim against any of the Releasees, or against any third party that may result in a claim against any of the Releasees, in respect of any matter in any way relating to or arising in connection with the Contest; and

    D. acknowledges and agrees that the Releasees make no warranty, guaranty or representation of any kind concerning any Prize and disclaim any implied warranty.

    E. consents to Purolator using their personal information, submitted within their entry, to contact the Entrant by phone, mail, or digital communications about the Contest. If the Entrant has also checked the box on the entry form to opt-in and receive communications, promotions, and product and/or service offerings from Purolator, they consent to Purolator using their personal information, submitted within their entry to be contacted by phone, mail, or digital communications. The Entrant may unsubscribe to any of these communications at any time.
  47. The Releasees shall not be liable to any Prize winner or any other person for failure to supply any Prize or any part thereof by reason of any acts of God, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labour dispute or strike, labour or material shortage, transportation interruption of any kind, or any other cause beyond the reasonable control of the Releasees.
  48. Sponsor reserves the right, to cancel, modify, suspend or terminate the Contest, to change any Contest evaluation or verification dates and to modify these Rules at any time without notice, for any reason, including, without limitation, if, in the opinion of the Sponsor, in its sole and absolute discretion:
    A. fraud, misconduct, plagiarism or technical failures destroy or threaten the integrity of any portion of the Contest;

    B. a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Contest; or

    C. there is any accident or printing, administrative or other error of any kind related to the Contest.

    In the event of an early termination of the Contest, Sponsor reserves the right to determine the Prize winners in an alternative process from among all eligible, non-suspect entries received as of the time/date of such termination.
  49. The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any Entrant or entry with these Rules, or as a result of technical problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules.
  50. The Sponsor may, in its sole and absolute discretion, and without notice, terminate the right of any Entrant, Candidate, or user of the Website to participate in the Contest or use the Website.
  51. In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, the Entry Comment, the French version of these Rules and/or point of sale, television, print or online advertising, the terms and conditions of these English Rules shall prevail, govern and control
  52. Except where prohibited by law, by completing the act of entering or participating in the Contest, each Entrant or Candidate agrees that the Contest, and all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, shall be governed by the laws in force in the Province of Ontario and the federal laws of Canada applicable therein (excluding any conflict of laws, rule or principle that might refer such interpretation to the laws of another jurisdiction). Each Entrant or Candidate irrevocably submits to the non-exclusive jurisdiction of the courts of Ontario with respect to any matter related to this Contest.
  53. In the case of Quebec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
  54. If any provision of these Rules is determined to be invalid or unenforceable, the remaining provisions of these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained herein.
  55. Except where prohibited by law, by participating in this Contest, each Entrant agrees that (a) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, and in no event will Entrant be entitled to receive lawyers’ fees or other legal costs; and (b) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
  56. All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by Purolator and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
A copy of these Rules are available during the Contest Period on the Contest Website. If you have any questions regarding the Contest, or if you would like a list of the Contest winners once they are named, please contact the Sponsor through its contact information on the Contest Website . In the event of any discrepancy or inconsistency between these Rules and any disclosures or other statements provided by Purolator representatives or contained in any Contest-related materials, including, but not limited to, print or online communications, these Rules shall prevail, govern and control.
