Contest Period
Purolator Dream Into Reality Contest (the “Contest”) commences at 12:00:01 AM EST on August 19th, 2019 and ends at 11:59:59 PM EST on September 16th, 2019 (the “Contest Period”). All entries must be received by 11:59:59 PM EST September 16th, 2019 (the “Contest Closing Time”). Entries submitted after the Contest Closing Time will not be accepted.
Eligible Persons
The Contest is open to individuals who are (a) an employee or representative of a Purolator business account holder in good standing at the time of entry and Prize award (“Purolator Business Account”) or an employee or representative of a small or medium business (“SMB”); where the SMB is eligible to be a prospective customer of Purolator (b) legal residents of Canada, who have reached the age of majority in his/her Province or Territory of residence at the time of entry, and enter the Contest in one of the following ways set out in paragraph 5. The Contest is not open to: (a) employees, directors, officers, representatives and agents of: (i) Purolator Inc. (the “Sponsor”); (ii) any affiliates of the Sponsor; (iii) any of the Sponsor’s advertising, promotion and fulfillment agencies involved in the development or execution of the Contest in any way; (iv) and Pinch and Dash (the “Contest Administrator”) and (v) any persons or entities involved in administering or judging the Contest; and (b) all persons with whom those specified in (a) are domiciled or immediately related. The persons and entities specified in (a) and (b) are referred to collectively herein as the “Contest Entities”. For the purposes of these Rules, two people are “immediately related” if one is the husband, wife, spouse, common-law partner, son, stepson, son-in-law, daughter, stepdaughter, daughter-in-law, sister, stepsister, sister-in-law, brother, stepbrother, brother-in-law, mother, stepmother, mother-in-law, father, stepfather or father-in-law of the other. For clarity, groups, clubs, organizations, businesses and commercial and non-commercial entities cannot enter the Contest. All potential winners, and their guests (if applicable), must possess a valid passport or other travel documentation enabling them to travel to the location of the destination where the Prize (as defined below) is made available by the Sponsor.
Every individual who enters the Contest (an “Entrant”) on behalf of a particular Purolator Business Account or SMB is responsible for determining whether any of that Purolator Business Account’s or SMB’s policies prohibit him/her from entering the Contest and receiving a Prize. Any individual who enters the Contest on behalf of a particular Purolator Business Account or SMB does so as agent for that Purolator Business Account and/or SMB and is required to obtain permission from that Purolator Business Account’s or SMB’s senior management prior to entering the Contest or being awarded a Prize. If such consent has not been obtained, Purolator reserves the right to void that Entrant’s entry and, in the case where that Entrant is a potential winner, the Prize may be forfeited and another eligible Entrant may be selected for the Prize in accordance with these Rules.
An Entrant must meet the eligibility requirements set out in these Rules from the time of entry until the time he/she is confirmed a winner (if he/she becomes a winner). Entrants are responsible for determining whether any policy prohibits them entering the Contest or receiving a Prize, or if any permissions are required from senior management of their business to enter or receive.
This Contest is subject to all applicable federal, provincial, and municipal laws and regulations. For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for ruling. Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
Entry Requirements. (No Purchase Necessary.)
This Contest involves, Entrants submitting their Entrant information on a contest web page (“Contest Website”) together with their written contest submission which shall consist of the Entrant’s description of their dreams and goals for their business (the “Submission(s)”) together comprising an entry (“Entry”). The contest can be entered in two ways. The first shall be by email invitation from Purolator sent by Purolator to existing Purolator Purolator Business Accounts who are in good standing (“Purolator Customers”).
Where Purolator has valid Purolator Customer email addresses on file, they will receive an email from Purolator inviting them to enter into the Contest, and this email will link to the Contest Website, in English: Purolator.com/DreamIntoReality and French: Purolator.com/Realisezvosprojetsdentreprise
There will also be banners on Purolator’s website which will advertise the Contest and which will have a link to the landing page to the Contest Website. Purolator Customers can also participate through the Purolator advertising for the Contest on Facebook and LinkedIn. If one of these Purolator Customer’s is the winning Entrant, and their account is in good standing, they shall be eligible to win the $10,000 in cash, plus $5000 in Purolator shipping credits, (“Grand Prize”) or the up to ten (10) $500 value shipping credits (as “Runners Ups”); as described in section 9 below.
The second way to enter the Contest; shall be from individuals working for Purolator prospective or potential SMB customers (“Purolator Prospects”). Purolator Prospects will be invited through paid advertisements by Purolator on social media; Facebook, Pinterest & Google to enter this contest by providing their written contest submission to the Contest Website link provided on the social media advertisement. If they win, Purolator Prospects shall only be eligible to win the $10,000 in cash, immediately. If a Purolator Prospect wants to also be eligible to receive the $5000 Purolator shipping credits for the Grand Prize or to receive one of the up to ten (10) $500 Purolator shipping credits as a Runner Up, they will need to sign up for a Purolator account within five (5) days of being the selected winning Entrant or Entrants, as set out in section 15.1 below.
By entering the Contest, each Entrant agrees that their entry is subject to the provisions of Section 16 below. Submissions will not be returned to the Entrants. The Winner will be required to complete the Declaration and Release described in Sections 18-21 below.
Limit of one (1) entry per person during the Contest Period. If any Entrant attempts to obtain more than the specified number of entries, the Sponsor may, in its sole and absolute discretion, disqualify the Entrant from the Contest and disqualify all of that Entrant’s entries.
All entries are subject to verification at any time. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility from any Entrant, which proof shall be in the form required by the Sponsor. Failure to provide proof of identity and/or eligibility to the satisfaction of the Sponsor in a timely manner may result in disqualification.
Prizes and Odds of Winning
There is a total of one (1) individual first prize (a “GrandPrize”) available to be won through the The Prize consists of CAD$10,000.00 (inclusive of HST) in cash, awarded by cheque, money order or money transfer and $5000 (inclusive of HST) in Purolator shipping credits. The $5000 in Purolator shipping credits will allow the winning Entrant to use a variety of Purolator services to ship packages up to the value of $5000. The $5000 in shipping credits cannot be converted into, or provided, in cash.
There will also be up to ten (10) runner up prizes (“Runner Up Prizes”) available to be won consisting of ten (10) $500 value Purolator shipping credits. As above, The $500 in Purolator shipping credits will allow the Runners Ups to use a variety of Purolator services to ship packages up to the value of $500, each. The $500 in shipping credits cannot be converted into, or provided, in cash.
The approximate odds of winning a Prize depend on the total number of eligible entries received by the Contest Closing Time.
The total Prizes are one (1) Grand Prize winner and ten (10) Runners Ups (as selected based on Section 14 below). The Grand Prize winner and Runner Ups must be at least the age of majority in their Province or Territory of residence at the time of entry.
All amounts and costs related to any Prizes, including but not limited to all income, sales, use and other taxes (and the reporting thereof) imposed as a result of the award of a Prize, which are not expressly covered by the Sponsor are the responsibility of the individual winners. It is the individual winners’ responsibility to understand and abide by any federal, provincial, territorial, local or foreign tax laws that may apply to receipt of a Prize.
The non-cash Prizes may not be redeemed for cash, sold, traded, used for commercial purposes or transferred. A person eligible to win a Prize must accept the Prize as awarded and may not transfer such Prize or substitute or exchange for, or apply the Prize’s value towards, cash or a higher cost or alternative prize. All Prizes are non-refundable, cannot be replaced if lost or stolen and are provided on an “as is” basis, without any representation or warranty of any kind. The Sponsor reserves the right, in its sole and absolute discretion, to make substitutions of equivalent or greater kind or value in the event of the unavailability of all or part of a Prize or for any other reason whatsoever.
How Prizes are Awarded
A judging panel will award the Prize to one (1) Grand Prize winner based on the winning Submission as determined in accordance with the Criteria and the process described below and in accordance with these Rules (including the verification requirements) (the “Winner Selection”). The same steps will be used to determine the ten (10) Runners Ups. The Winner and Runners Up Selection will start on September 18th, 2019 beginning at approximately 11:00 AM EST in Toronto, Ontario from all eligible Contest entries received during the Contest Period. The Sponsor shall offically and publicly announce the Grand Prize Winner and up to 10 Runner Up winners by email and social media, any time starting after October 21st, 2019. The Competition will be judged in 3 phases:
Phase 1: All Entrants will be entered into a pre-screening process whereby all submissions will be evaluated by a Third party agency team, with the agency being Response Innovations, of up to 10 people. The pre-screening process will evaluate submissions based on Phase 1 Criteria (as defined below). Each submission will be assigned a score out of15. In the event that there are more than 25 submissions with a score of 10, the pre-screening panel will re-evaluate the tied submissions to further narrow down the list to achieve the top 25 submissions.
Phase 2: The Contest Administrator will consolidate all pre-screened evaluations and compile a list of the top 25 submissions (based on score) which will be presented to the final judging panel comprised of 5 people (all 5 individuals from Sponsor). Each judge will receive the same 25 submissions, and will evaluate each submission against the Phase 2 &3 Criteria (as defined below) assigning each submission a score out of 15. All scores for each submission will be added together and the 15 submissions with the highest score will proceed to the final evaluation in Phase 3.
Phase 3: The judges will be presented with the 15 finalist submissions and will evaluate each Submission against the Phase 2&3 Criteria, assigning each Submission a score out of 15. All scores for each submission will be added together and the submission with the highest score will be declared the winner (“Winner”) on September 26th, 2019. In the event of ties, the judges will each cast 1 vote, and the submission with the most votes will be declared the Winner, and then in order of declining scores the subsequent 10 Runners Ups will be chosen. The top 15 finalized will be ranked in order of scoring; and used as alternate winners in declining order, if necessary.
Judging Criteria: Phase 1 Criteria: Submissions will be evaluated on the following criteria 1) Impact & Attention: the ability of the message to grab and hold attention of the audience; 2) Creativity: creativity and the originality of idea and 3) Clarity of Message: the clarity and effectiveness of the message. Each of the above Criteria will be weighted equally, with a maximum value of 5 points being awarded in each of the 3 categories above, for a maximum total score of 15 points per entry. Entrants will also be eliminated if the Submission does not follow the requested theme of ’’Challenges and Growth” or a positive brand tone. Phase 2&3 Criteria: Entrants will be evaluated on the following criteria 1) Impact & Attention: the ability of the message to grab and hold attention of the audience and 2) Creativity: creativity and the originality of idea and 3) Clarity of Message: the clarity and effectiveness of the message. Each of the above Criteria will be weighted equally, with a maximum value of 5 points being awarded in each of the 3 categories above, for a maximum total score of 15 points per entry.
Grand Prize Winner and Runners Ups Notification: The Grand Prize Winner and Runners Ups will be contacted by the Sponsor or the Contest Administrator by telephone or email within five (5) business days of the Prize being Awarded on September 26th, 2019. In the event that the Sponsor or the Contest Administrator is unable to contact the selected Entrants by telephone, email or social media after three (3) attempts within five (5) business days of the Prize Draw and by October 3rd, 2019 at 12:00:00 PM, the Sponsor reserves the right to disqualify the selected Entrants and such Entrant will be deemed to have forfeited his/her entitlement to receive the Prize, at which time alternate Entrants,will be awarded the Grand Pize and subsequent Runners Up prizes. Neither the Sponsor nor the Contest Administrator will be responsible for any failed attempts to contact selected Entrants.
15.1 If the Winner and Runners Up chosen are Purolator Prospects, then a Puroaltor representative shall have until October 3rd,2019 to contact them to ask them whether or not they will become a Purolator account holder; if the Grand Pize Winner would like to be eligible to receive the second portion of the prize, the $5000 in Purolator shipping credit or the up to ten (10) Runners Ups would like to receive their $500 in Purolator shipping credits, they shall have until October 7th, 2019 to let Purolator know. They have until October 9th, 2019 to apply to become a Purolator account holder, and by October 11th, 2019 they shall provide Purolator their account number or the second part of the prize will not be awarded to the Grand Pize Winner and the Runners Ups who have not submitted this information, will not recieve the $500 Purolator credit Runners Up prizes.
If the first alternate Entrant is disqualified as the Grand Prize Winner, another alternate potential Grand Prize Winner will be selected from among the remaining eligible entries, through a process similar to the one that selected the original potential Winner, subject to these Rules. Through the winner notification process, the potential Winner must confirm his/her eligibility and indicate his/her willingness to accept the applicable Prize. The potential Winner will then receive official notification via email. No communications will be entered into other than with the potential Winners.
Similarly for the Runners Up, if they do not confirm their eligibility and indicate their willingness to accept the applicable prize; then alternate and subsequent Runners Ups may be chosen, in their place, based on the Rules of the Contest.
Submission Requirements
By participating in the Contest, each Entrant agrees to be bound by these Rules and by the interpretation of these Rules by the Sponsor, and further warrants and represents that his/her Submission:
is original to him/her and that the Entrant has all necessary rights in and to the submission (and all components thereof – e.g. music, images, etc) to enter the Contest;
does not violate any law, statute, ordinance or regulation;
does not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence;
will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims for payment whatsoever; and
is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following:
Nudity;
Alcohol/drug consumption or smoking;
Explicit or graphic sexual activity, or sexual innuendo;
Crude, vulgar or offensive language and/or symbols;
Derogatory characterizations of any ethnic, racial, sexual or religious groups;
Content that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct;
Personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic);
Commercial messages, comparisons or solicitations for products or services other than products of Sponsor;
Any identifiable third party products, trade-marks, brands and/or logos, other than those of Sponsor. For example, any clothing worn and/or products appearing in your Video must not contain any visible logos, trade-marks or other third party materials (note: all identifiable third party products, trade-marks, brands and/or logos must be blurred out so as to be unrecognizable);
Conduct or other activities in violation of these Rules; and/or
Any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole discretion.
The Sponsor (the “Reviewer”) may initially screen each Submission. Any submission that the Reviewer deems, in its sole discretion, to violate the terms and conditions set forth in these Rules will not be posted or submitted for entry into the Winner Selection.
By entering the Contest and submitting an entry, each Entrant: (i) grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use his/her submission, in whole or in part, for advertising or promoting the Contest or for any other reason; (ii) waives all moral rights in and to his/her submission in favour of the Sponsor; and (iii) agrees to release and hold harmless the Sponsor, the Contest Administrator and each of their respective agents, employees, directors, successors, and assigns (collectively, the “Releasees”) from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action.
Declaration and Release
Before being confirmed as the Winner of the Grand Prize, or the ten (10) Runners Ups, the potential Grand Prize Winner and Runners Ups must each complete and return, by - October 11th 2019, a Declaration and Release Form (the “Declaration and Release”), which (among other things):
A. Confirms compliance with these Rules;
B. acknowledges acceptance of the Prize as awarded;
C. releases the Contest Entities and their affiliates and each of its and their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, the potential Winner’s participation therein and the awarding and use/misuse of the Prize or any portion thereof or participation in any Prize-related activity;
D. confirms the potential Winner’s consent to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph and/or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including, without limitation, print, broadcast, mobile and the internet (“Promotion(s)”);
E. authorizes the Sponsor to modify the submission for the puroposes of the Promotions; and
F. assigns all copyright in the submission to the Sponsor and its affiliates, and waives any moral rights the Entrant may have in the submission.
If a potential Grand Prize Winner or potential Runners Ups fail to return the properly executed Declaration and Release within the specified time period, the Sponsor may, in its sole and absolute discretion, disqualify them, thereby forfeiting any and all rights to a Prize. In the event of such a disqualification, an alternate potential Grand Prize Winner, and alternative Runners Ups, will be selected from among the remaining eligible entries, through a process similar to the one that selected the original potential Grand Prize Winner and Runners Ups, subject to these Rules.
If a selected potential Grand Prize Winner, or Runners Ups; do not meet the eligibility requirements, do not complete and return the Declaration and Release,are unable or unwilling to accept the Prize as offered or elects to decline the Prize, they will be disqualified and an alternate potential Grand Prize Winner, and alternate Runners Ups; will be selected from among the remaining eligible entries, through a process similar to the one that selected the original potential Grand Prize Winner, and Runners Ups; subject to these Rules. Any disqualified Winner will not receive any alternate prize, substitution or compensation.
Upon satisfaction of all requirements of these Rules, including, without limitation, receipt of the completed Declaration and Release, the final Grand Prize Winner and Runnrs Ups will be contacted to make Prize delivery arrangements. The Prize will be delivered to the Winner at the latest by October 31st, 2019.
Privacy
The Sponsor respects your right to privacy and works at all times to comply with all applicable data protection and privacy laws. Except as expressly set out in these Rules, in the Sponsor’s Privacy Policy (available at https://www.purolator.com/en/legal/privacy.page? ), or as otherwise agreed to by you, any personal information provided in connection with this Contest will only be collected, used and disclosed by the Sponsor and its third party partners and service providers, including, without limitation, the Contest Administrator, for the purposes of administering and conducting this Contest, including, without limitation, verification of eligibility and identity and awarding and delivering Prizes. Such information will be subject to the general laws applicable within those jurisdictions, including, without limitation, possible access by regulatory authorities. The Sponsor will not sell, share or otherwise disclose personal information provided in connection with this Contest to or with third parties or agents, other than to third parties or agents engaged by the Sponsor to fulfill the above purposes or as permitted or required by the applicable laws.
Additional Rules and Restrictions
By participating in this Contest, Entrants agree to abide by and be bound by these Rules and the decisions of the Sponsor and the Contest Administrator, which shall be final and binding on all Entrants in all matters relating to this Contest. In the event an Entrant wins a Prize and is later found to be in violation of these Rules, he/she will be required to forfeit the Prize or to reimburse Sponsor for the stated value of the Prize if such violation is discovered after winner has used the Prize. False, fraudulent or deceptive entries or acts shall render Entrants ineligible for the Prize.
Proof of sending (regardless of method) is not proof of receipt by the Sponsor or Contest Administrator. Incomplete, altered, mutilated or garbled entries will be disqualified. The Releasees are not responsible for lost, late, misdirected, garbled, stolen, incomplete, invalid, unintelligible or damaged entries, or for entries submitted in a manner that is not expressly allowed under these Rules, or for any entry not submitted or received due to any technical error or failure, unauthorized human intervention, inaccurate capture or mis-entry of any required information, the effects of hackers, the failure of any electronic equipment, computer transmissions and/or network connections or any other reason beyond Sponsor’s reasonable control; all of which will be disqualified. The Releasees are not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including, without limitation: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online Entrant's ability to participate in the Contest, and any injury or damage to Entrant’s or any other person’s computer related to or resulting from participating in or downloading any information necessary to participate in the Contest. Entrants are restricted to use of ordinary and typical computer equipment and internet access use in respect of the Contest.
The Releasees are not responsible for the cancellation or postponement of any component of this Contest or any associated programs and materials. The Releasees are not responsible for any other errors of any kind, whether computer, technical, typographical, printing, display, human or otherwise, relating to or in connection with the Contest. The Releasees are not responsible for typographical or other errors in the offer or administration of this Contest, including, without limitation, errors which may occur in connection with the printing, display or advertising of this Contest, these Rules, administration or execution of the Contest, the conducting of the prize drawing, the cancellation of any element of a Prize, the processing of entries or in the selection or announcement of a Prize or Prize winner.
Each Entrant must submit an entry and participate in the Contest on his/her own behalf. Any entry submitted on behalf of another individual, on behalf of a group or organization, or using another person’s email address, name or other personal information will be disqualified and ineligible to claim any Prize.
Any attempt by any Entrant to obtain more than the specified number of entries by using (or attempting to use) multiple names, identities, email addresses, registrations or logins, or by any other means whatsoever, will entitle the Sponsor, in its sole and absolute discretion, to void that Entrant’s entries and disqualify that Entrant from the Contest. Entries by any means which subvert the entry process will be void. Any entry that is determined by the Sponsor, in its sole and absolute discretion, to have failed to have been fully completed and submitted during the Contest Period will be rejected. Use (or attempted use) of any automated, macro, script, robotic or other systems or programs to enter or otherwise participate in, subvert or disrupt the Contest, and any other attempt to manipulate, tamper with or defraud any element of this Contest, is prohibited and is grounds for disqualification by the Sponsor in its sole and absolute discretion.
In the event of a dispute as to any entry, the authorized account holder of the email address included in the Entry for that entry will be deemed to be the Entrant and he/she must be eligible according to these Rules. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. All entries received become the property of the Sponsor and will not be returned or acknowledged.
The sole determinant of the time of receipt of an entry for the purposes of determining the eligibility of that entry shall be Purolator’s or the Contest Administrator's computer or server.
By participating in the Contest, except to the extent prohibited by applicable legislation, each Entrant:
A. consents to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph and/or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including, without limitation, print, broadcast and the internet and any winning Entrants, Grand Prize and Runners Ups; agree to work with Purolator on the creation of videos and other content creation regarding their stories and their personal biographies;
B. releases and agrees to defend and indemnify the Releasees from and against any and all liability, claims, losses, actions or damages of any kind, whether actual, incidental or consequential, for injury (including but not limited to death), damages, losses or expenses arising out of or relating to an Entrant’s participation in this Contest, or the acceptance, possession or use/misuse of any Prize or participation in prize-related activities (including but not limited to activity related thereto);
C. agrees not to make any claim against any of the Releasees, or against any third party that may result in a claim against any of the Releasees, in respect of any matter in any way relating to or arising in connection with the Contest; and
D. acknowledges and agrees that the Releasees make no warranty, guaranty or representation of any kind concerning any Prize and disclaim any implied warranty.
The Releasees shall not be liable to Prize winners or any other person for failure to supply any Prize or any part thereof by reason of any acts of God, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labour dispute or strike, labour or material shortage, transportation interruption of any kind, or any other cause beyond the reasonable control of the Releasees.
Sponsor reserves the right, to cancel, modify, suspend or terminate the Contest, to change any Contest draw dates and to modify these Rules at any time without notice, for any reason, including, without limitation, if, in the opinion of the Sponsor, in its sole and absolute discretion:
A. fraud, misconduct, plagarism or technical failures destroy or threaten the integrity of any portion of the Contest;
B. a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Contest; or
C. there is any accident or printing, administrative or other error of any kind related to the Contest.
In the event of an early termination of the Contest, Sponsor reserves the right to determine the Prize winners in an alternative process from among all eligible, non-suspect entries received as of the time/date of such termination.
The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any Entrant or entry with these Rules, or as a result of technical problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules.
The Sponsor may, in its sole and absolute discretion, and without notice, terminate the right of any Entrant or user of the Website to participate in the Contest or use the Website.
In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, the Entry Comment, the French version of these Rules and/or point of sale, television, print or online advertising, the terms and conditions of these English Rules shall prevail, govern and control.
Except where prohibited by law, by completing the act of entering the Contest, each Entrant agrees that the Contest, and all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, shall be governed by the laws in force in the Province of Ontario and the federal laws of Canada applicable therein (excluding any conflict of laws, rule or principle that might refer such interpretation to the laws of another jurisdiction). Each Entrant irrevocably submits to the non-exclusive jurisdiction of the courts of Ontario with respect to any matter related to this Contest.
In the case of Quebec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement”.
If any provision of these Rules is determined to be invalid or unenforceable, the remaining provisions of these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained herein.
Except where prohibited by law, by participating in this Contest, each Entrant agrees that (a) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, and in no event will Entrant be entitled to receive lawyers’ fees or other legal costs; and (b) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
